These Terms of Service (“Terms”) govern access to and use of the BowlCast live streaming platform, related websites, APIs, and on-premises edge software (collectively, the “Service”). By creating an account, accepting an invite, purchasing a subscription, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Electronic acceptance (including completing registration, clicking to accept, or continuing to use the Service after notice of updates) constitutes agreement to these Terms.
1. Introduction
BowlCast helps organisations (such as bowling centres and venue operators) schedule and operate live streams to YouTube, including camera and on-premises edge ingestion where configured. The Service is offered as a paid subscription product, subject to these Terms.
Features may change over time. We do not guarantee that any particular feature will remain available indefinitely.
2. Eligibility
You must be at least 18 years old, able to form a binding contract under applicable law, and use the Service only on behalf of yourself or an organisation that has authorised you. If you use the Service for an organisation, you represent that you have authority to bind that organisation to these Terms. References to “you” include that organisation.
3. Account registration
3.1 Invite-only access
Access is invite-only. Accounts are created when an authorised owner or administrator invites a user, and the invitee completes registration with email and password. Open self-signup is not offered.
3.2 Authentication
You sign in with email and password. Authentication information may be stored in your browser to maintain your signed-in session. BowlCast does not use Google Sign-In to authenticate BowlCast accounts. Cookies and browser storage are described in the Privacy Policy.
3.3 Account information
You must provide accurate registration information (including name and email) and keep credentials confidential. You are responsible for activity under your account. Notify us promptly at support@bowlcast.tv if you suspect unauthorised access.
3.4 Roles and organisations
Users belong to an organisation (tenant) with roles such as admin or member. Organisation administrators may invite, deactivate, or remove members subject to product constraints (for example, an admin cannot delete themselves or the primary organisation admin through the member-delete flow).
4. User responsibilities and venue content
You agree to:
- Use the Service only for lawful purposes and in accordance with these Terms (including Acceptable Use below).
- Maintain the security of your passwords, devices, cameras, and edge hosts.
- Ensure you have all rights, licences, and consents needed for content you stream or schedule, including camera feeds, venue footage, music, and branding.
- Obtain any consents required by law for filming or streaming patrons, staff, guests, or minors at your venues. You are solely responsible for privacy, publicity, and similar claims arising from people appearing in your streams.
- Comply with YouTube and Google policies when connecting a channel or publishing content.
- Not share account credentials or circumvent access controls.
- Keep payment methods current for paid subscriptions.
5. Acceptable use
You must not use the Service to upload, schedule, stream, store, or transmit content or engage in activity that:
- Violates applicable law, regulation, or court order, or facilitates fraud or other criminal activity.
- Infringes copyright, trademark, publicity, or other rights of any person (including unauthorised sports feeds, music, or third-party broadcasts).
- Involves child sexual exploitation or abuse material (strictly prohibited), or constitutes harassment, hate speech, threats, or extreme violence where prohibited by law or YouTube policy.
- Sends unsolicited bulk invitations or messages, impersonates others, or misrepresents affiliation with BowlCast, Google, or YouTube.
- Streams camera feeds or venues without required consent or rights, or uses another organisation’s YouTube channel, credentials, or stream keys without authorisation.
- Attempts to probe, scan, penetrate, or disrupt BowlCast infrastructure, APIs, edge devices, or other users; introduces malware; or bypasses rate limits or authentication.
- Reverse engineers, decompiles, or creates derivative works of the Service or edge software except where mandatory law allows.
- Scrapes or harvests data from the Service except through documented product features you are authorised to use.
- Shares login credentials across unauthorised users, creates accounts via forged invites, or uses another user’s session or API credentials.
- Exceeds or circumvents YouTube quotas or API restrictions, uses OAuth tokens for purposes other than user-authorised YouTube operations through BowlCast, or violates YouTube or Google API policies.
- Tampers with edge registration, secrets, or pipelines belonging to another organisation, or redirects streams to unauthorised destinations.
- Abuses “unlimited” or high-volume marketing claims through unreasonable load, automated abuse, or conduct that degrades the Service for others. We may apply fair-use limits or suspend abusive use.
Report suspected abuse or illegal content to support@bowlcast.tv. We may investigate, remove content from BowlCast systems, disconnect YouTube channels from BowlCast, suspend accounts, or terminate organisations, and may cooperate with law enforcement or YouTube/Google where required.
6. YouTube integration
6.1 Channel connection
Separately from BowlCast login, authorised users may connect a YouTube channel via Google OAuth. The Service requests the OAuth scope https://www.googleapis.com/auth/youtube.force-ssl so BowlCast can perform user-authorised YouTube operations (for example, managing live broadcasts, live streams, and playlists). We do not request Google Sign-In scopes for BowlCast account login.
6.2 YouTube terms
By using BowlCast’s YouTube features, you also agree to be bound by the YouTube Terms of Service and Google Privacy Policy. YouTube API use is also subject to Google’s API terms and developer policies.
6.3 Actions on your behalf
When a channel is connected, BowlCast may create, modify, start, stop, or delete YouTube live broadcasts, streams, playlists, and related resources on your behalf within the permissions you granted and actions taken by your authorised users.
6.4 Ownership and policy risk
You (or your organisation) remain the owner of your YouTube channel and content. BowlCast does not claim ownership of your YouTube videos or channel. YouTube quotas, policy enforcement, strikes, demonetisation, and outages may limit or interrupt features. You bear that risk. We may disconnect or suspend YouTube integration if continued use creates API or policy risk to the Service.
6.5 Disconnect
Authorised users may disconnect a channel in the Service. Disconnect attempts to revoke Google access and removes the stored channel connection and associated OAuth tokens from BowlCast. You may also revoke access in your Google Account permissions. Revoking access does not delete your YouTube content.
7. Subscriptions and billing
7.1 Paid plans
Paid access is provided through recurring subscriptions billed via Stripe. Plans and prices are set in our catalogue (for example monthly or yearly intervals) and shown at checkout. Amounts are charged in the currency displayed at purchase. Card and payment-method data are handled by Stripe; we do not store full card numbers.
7.2 Automatic renewal
Subscriptions renew automatically at the end of each billing period until cancelled as described below. You authorise Stripe to charge your payment method for renewal fees and applicable taxes as presented at checkout or on invoices.
7.3 Plan changes
You may change plans through the Stripe Customer Portal where enabled. Mid-cycle plan changes may generate prorated charges or credits as calculated by Stripe (proration invoicing). Those proration charges are not a separate “cancel for free” of the whole subscription.
7.4 Failed payment and past due
If payment fails, your organisation may enter a past-due state and certain features may be restricted. Continued non-payment may result in cancellation or termination of paid access.
7.5 Complimentary access
We may grant complimentary or temporary access (for example admin-granted “super access”) without a Stripe charge. Complimentary access is not a paid Stripe trial, creates no entitlement to refunds, and may end at our discretion. When you convert to a paid subscription, these billing and refund rules apply to paid payments from that point.
7.6 Price changes
We may change prices for future billing periods. We will provide notice where practicable (for example email or in-product notice). Price changes do not retroactively alter amounts already successfully charged for a completed period, except as Stripe proration already allows for plan changes.
7.7 Taxes
Fees may be exclusive or inclusive of taxes as shown at checkout or on invoices. You are responsible for taxes applicable to your purchase except taxes based on our income.
8. Cancellation
You may cancel a paid subscription through the Stripe Customer Portal (accessible from organisation billing settings where available). Cancellation is generally effective at the end of the current billing period: you retain access until that period ends, and we do not provide a prorated refund of unused time solely because you cancel mid-period, except as required by law or under the Refunds section below.
Cancelling a subscription does not automatically delete organisation data. Data retention and offboarding are described in the Privacy Policy and Section 15.
9. Refunds
9.1 Commercial refund rule (7-day, no live stream)
Within seven (7) calendar days of a successful subscription payment (the initial charge and each subsequent renewal payment for a subscription period), an authorised organisation administrator may request a full refund of that payment by emailing support@bowlcast.tv, provided that:
- The request is received within those seven calendar days; and
- No broadcast belonging to the organisation has gone live in BowlCast during those seven calendar days after that payment.
“Gone live” means BowlCast has recorded an actual start time for a broadcast (the stream was started / went live). Short or later-failed streams still count if an actual start time was recorded. Setup-only actions—logging in, inviting users, adding cameras, connecting YouTube, or scheduling without going live—do not by themselves make a payment non-refundable under this rule.
9.2 Payment and clock
- A “payment” means a successful Stripe charge or paid invoice for a subscription period (initial or renewal). Unpaid or failed invoices are not refundable as payments under this section.
- The seven-day window is measured from the payment timestamp as recorded by Stripe, evaluated in UTC.
- Each successful subscription-period payment has its own seven-day window for that payment only.
- Mid-cycle plan-change proration invoices follow Stripe’s proration rules and are not covered by a separate seven-day “no stream” cancel of the entire subscription, except where the charge is itself a subscription-period payment described above or where law requires otherwise.
9.3 How to request
Email support@bowlcast.tv from an authorised admin account and include: organisation name, account email, and the invoice or payment reference. Eligibility is assessed based on usage through the time of the request. If a broadcast goes live after you request a refund but before we process it, we may deny the refund.
9.4 How refunds are issued
Approved refunds are processed manually via the Stripe Dashboard to the original payment method. We use reasonable efforts to process approved refunds within several business days after approval; final timing also depends on banks and card networks. There is no in-app or automated refund button. Refund of a payment may end or adjust subscription access for the related period as processed in Stripe.
9.5 When this commercial refund does not apply
Except where required by applicable law (including non-excludable Australian Consumer Law rights where they apply), or as we choose to grant a credit or refund for a material BowlCast service failure, or for a duplicate or incorrect charge after verification:
- Payments are non-refundable after a live stream in the seven-day window, or after the seven-day window ends.
- Mid-period cancellation alone does not create a prorated refund.
- Complimentary access is not refundable.
9.6 Chargebacks and payment disputes
Contact support@bowlcast.tv before initiating a chargeback or payment dispute with your bank or card issuer. Unwarranted chargebacks may result in suspension of the Service. We may contest improper disputes and provide evidence of usage and these Terms.
10. Third-party services
The Service depends on third parties, including Stripe (payments), Google OAuth, YouTube API Services, email delivery (SMTP), hosting and infrastructure, and—where deployed—on-premises edge hardware and software. Your use of Google, YouTube, and Stripe is also subject to their terms. We are not responsible for third-party outages, policy changes, quotas, or payment-network delays.
11. Intellectual property
BowlCast and its licensors own the Service software, branding, and documentation. You retain rights in your content and organisation data, subject to the licences needed for us to operate the Service (host, process, transmit, and display content as required to provide features you use).
You must not reverse engineer, scrape, or misuse the Service except as permitted by law or Section 16 (Edge Software Licence).
Feedback you provide may be used by us to improve the Service without obligation to you. You grant us a worldwide, royalty-free, perpetual licence to use feedback for that purpose. Do not include confidential third-party information you are not authorised to share.
12. Service availability and changes
We aim to keep the Service available but do not guarantee uptime, uninterrupted streaming, or uninterrupted YouTube connectivity. Maintenance, defects, third-party failures, and network or hardware issues may cause downtime or failed streams. There is no Service Level Agreement (SLA) and no entitlement to uptime credits unless we expressly grant them in writing for a specific incident.
We may modify, suspend, or discontinue features. Material changes to these Terms will be notified by email or in-product notice where practicable. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service and cancel any subscription.
13. Support
Support is provided on a best-effort basis during business hours (Australia/Melbourne) via support@bowlcast.tv, in English unless we agree otherwise. Support covers account access, YouTube connect issues, scheduling and live operation within BowlCast, and bug reports. Support does not include guaranteed response times, custom development, YouTube policy outcomes, on-site hardware installation (unless separately agreed), or support for modified/unofficial edge builds.
Security vulnerabilities should be reported to support@bowlcast.tv with a description, affected component, and non-destructive reproduction steps. Do not access others’ data or disrupt the Service while testing.
14. No warranty
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR THAT STREAMS WILL SUCCEED.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies under the Australian Consumer Law or other laws that cannot be excluded by contract. Where our liability can be limited in relation to goods or services not of a kind ordinarily acquired for personal, domestic, or household use, our liability is limited (at our option) to resupply of the services or payment of the cost of resupply.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BowlCast LLC AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED AUSTRALIAN DOLLARS (AUD 100) OR EQUIVALENT.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted, and non-excludable rights remain.
16. Indemnification
You will defend and indemnify BowlCast LLC against claims, damages, and expenses (including reasonable legal fees) arising from: (a) your content or streams (including claims by patrons or third parties appearing in footage); (b) your breach of these Terms; (c) your violation of YouTube/Google policies or third-party rights; or (d) unauthorised use of your account.
17. Suspension, termination, and data
We may suspend or terminate access immediately if you breach these Terms, create risk to the Service or others, fail to pay, or as required by law or third-party providers. Organisation administrators may deactivate or remove members. You may stop using the Service at any time and cancel subscriptions as described above.
Upon termination, your right to use the Service ends. Organisation data is not automatically wiped on cancel or termination; it is retained under the Privacy Policy until deleted through admin tools or support-assisted offboarding. You must uninstall edge software and delete local secrets when access ends.
There is currently no self-serve “delete my organisation” wipe for end customers. To request offboarding assistance, email support@bowlcast.tv with your organisation name and requirements (member removal, channel disconnect, content deletion, or full offboarding). Backups and logs may retain copies for a limited period after deletion.
Provisions that by nature should survive (including IP, warranty disclaimers, liability limits, indemnity, governing law, and surviving billing obligations) will survive.
18. Edge software licence
If you install or operate BowlCast edge software, installers, container images, scripts, or related documentation (the “Edge Software”) on your premises:
- We grant you a limited, non-exclusive, non-transferable, revocable licence to install and run the Edge Software solely on hardware you own or control for connecting authorised cameras/sources to BowlCast under a valid organisation account.
- You must not copy, distribute, sublicense, sell, lease, reverse engineer (except where mandatory law prohibits this restriction), remove proprietary notices, or use another organisation’s device credentials.
- Keep registration codes and device credentials confidential. Secure the host (patches, network isolation, physical access).
- The Edge Software may store locally device identity, control-plane credentials, camera configuration (including credentials), and stream state. You are responsible for securing that host.
- We may provide updates; failure to update may cause loss of compatibility or support.
- Third-party and open-source components remain under their own licences.
- BowlCast retains ownership of the Edge Software. Camera footage and venue content remain your responsibility under these Terms.
- THE EDGE SOFTWARE IS PROVIDED “AS IS” subject to Section 14. You assume risk of local data loss, disk failure, and on-premises network issues.
- This licence ends if you breach these Terms, your organisation access ends, or we discontinue the Edge Software. Then you must stop using the Edge Software and delete local copies and secrets, except copies required by law.
19. Force majeure
We are not liable for delay or failure to perform due to events beyond our reasonable control, including natural disasters, war, terrorism, labour disputes, internet or power failures, or failures of third-party platforms (including Stripe, Google, or YouTube).
20. Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganisation, or sale of assets.
21. Notices
Notices to BowlCast must be sent to support@bowlcast.tv. Notices to you may be sent to the email associated with your account or organisation, or provided in-product.
22. General
- Entire agreement. These Terms (together with the Privacy Policy and any order or checkout terms presented at purchase) are the entire agreement between you and us regarding the Service and supersede prior understandings on that subject.
- Severability. If a provision is unenforceable, the remainder remains in effect.
- Waiver. Failure to enforce a provision is not a waiver of future enforcement.
- No partnership. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
- Relationship to Privacy Policy. Personal data is handled under the Privacy Policy. If there is a conflict on privacy subject matter, the Privacy Policy controls for that subject matter; otherwise these Terms control.
- Order of precedence. For paid checkout, Stripe’s presented checkout terms apply to payment processing mechanics; these Terms govern your relationship with BowlCast for the Service.
23. Governing law
These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law rules. The courts of Victoria, Australia have exclusive jurisdiction, subject to mandatory consumer protections that cannot be waived.
